  • No age limit – As of 2022, Oregon does not have an age limit as to who can purchase CBD products. There is no prohibition against the sale of CBD products to those under 21 years old; however, there are limitations if CBD is to be inhaled. Those wishing to purchase inhalable CBD for an inhalant delivery system, like a vape, must be at least 21 years old.
  • No possession limit – There are currently no limitations on the quantity of CBD an individual can possess as long as the CBD product is derived from industrial hemp. CBD oil derived from marijuana, however, must be no more than 72 ounces.
  • THC concentration – Under Oregon’s Hemp Program, all hemp-derived CBD is legal if its concentration is no more than 0.3% THC. All CBD products that are under this amount are safe to use without consequence. 
  • CBD licensing – The ODA’s Hemp Program does not require businesses to possess a license to sell any type of CBD product, but it does require hemp growers to obtain a license before they grow, harvest or dry hemp.
  • CBD in food and beverages –Under the Federal Food, Drug and Cosmetic Act, which is enforced by the U.S. Food and Drug Administration (FDA), CBD products cannot be labeled or advertised as a dietary supplement. However, food and beverages containing CBD are allowed. 
  • CBD in alcohol – In 2018, the Oregon Liquor Control Commission (OLCC) prohibited liquor wholesalers from manufacturing, storing, selling or transporting any alcoholic beverage that contains CBD. 

Is CBD Legal in Oregon?

In 2014, Oregon led the pack and legalized the recreational and medicinal use of cannabis products, which included CBD products. While the 2018 Farm Bill has only legalized hemp-derived CBD products, Oregon still permits the use of CBD derived from both hemp and marijuana. That said, you must have a medical license to buy marijuana-derived CBD products.

Before 2021, the manufacturing, sale and distribution of hemp-derived CBD was regulated by the Oregon Department of Agriculture (ODA)’s Hemp Program. This program controlled the harvesting requirements and ensured that growers and handlers comply with Oregon CBD laws. The ODA also oversaw manufacturers to ensure that CBD is safe to consume. 

In 2021, HB 3000 was passed, which transferred the regulatory authority of CBD from the ODA to the Oregon Liquor and Cannabis Commission (OLCC). This shift in oversight has introduced some inconsistencies in Oregon law regarding CBD, as the regulatory framework between the ODA and OLCC is quite different. Since these laws are always changing, it may take a few years to iron out these kinks.
