Arizona is a CBD-friendly state and doesn’t have additional specifications for the purchase of CBD and other hemp-based products beyond what’s detailed in the federal 2018 Farm Bill. 

Shortly after the federal government passed the Farm Bill in 2018, the Arizona State Legislature passed Senate Bill 1098, which laid out the rules for the “growth, cultivation and marketing of industrial hemp.” The bill established some important Arizona CBD laws like:

  • Legal status – All hemp-derived products with a THC content of less than 0.3% by dry weight are considered agricultural products.
  • Oversight – The Arizona Department of Agriculture oversees the cultivation and growth of hemp products in the state. 
  • Research – Institutions can conduct research on how to grow, market and cultivate hemp.
  • Licensing – Anyone who wants to grow, cultivate, transport or establish a nursery for industrial hemp must apply for a license from the Department of Agriculture. Growers are required to submit a pre-planning report, keep accurate records and provide periodic updates to the Department of Agriculture on the growth of their plants, including THC tests and inspections. 
  • Personal use – It is not legal to grow hemp for personal use in Arizona. 

Is CBD Legal in Arizona?

In Arizona, hemp-based products like CBD oils and tablets have been reclassified as their own type of agricultural product, separate from marijuana. 

According to the Arizona Department of Agriculture, hemp is “the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a Total Delta-9 Tetrahydrocannabinol (THC) concentration of not more than three-tenths percent (0.3%) on a dry-weight basis. This includes the total calculable amount of the conversion of Tetrahydrocannabinolic Acid (THCA).”

Hemp-derived CBD comes in three main forms:

  • Isolate – Contain only CBD (which stands for cannabidiol), one of more than 85 active cannabinoids in the cannabis plant
  • Full-spectrum – Include many cannabinoids and chemical compounds from the cannabis plant, including up to 0.3% THC
  • Broad-spectrum – Include all the same compounds as full-spectrum CBD, just without the THC
